Different fees must be paid at various times during the patent application process. The table below shows the more commonly paid fees.

Application fee
Also described previously as the filing fee, its payment will no longer be a requirement to obtain a filing date.

However, if it is not paid at time of filing, it will be considered late and subject to a late fee.

Request for examination
Your application will not automatically be examined simply because you have filed it.

A formal written request for examination must be made along with the payment of the examination fee. This request must be made within four years of the Canadian filing date; otherwise, your application will be deemed abandoned.

Request for advanced examination
The advanced examination fee is in addition to the request for examination fee, but no additional fee is required for the accelerated examination service of patent applications related to technologies mitigating environmental impacts.

Please note that CIPO will not consider an advanced examination request for an application unless it has been laid open to public inspection and a request for examination has been made.

Final fee (before grant)
The final fee is paid after the examiner finds your patent application to be allowable.

A Notice of Allowance will be sent, requiring payment of the final fee within 4 months from the date of the notice.

Maintenance fees

Each year a maintenance fee must be paid in order to maintain a patent application in effect or to maintain the rights accorded to a patent.

The small entity status condition is that

  1. in respect of an application for a patent — other than a PCT national phase application or a divisional application — the applicant of the application on the filing date is, on that date, an entity that has 50 employees or less or is a university, other than
    1. an entity that is controlled directly or indirectly by an entity, other than a university, that has more than 50 employees, or
    2. an entity that has transferred or licensed, or has an obligation other than a contingent obligation to transfer or license, any right or interest in a claimed invention to an entity, other than a university, that has more than 50 employees;
  2. in respect of an international application, the applicant of the application on the national phase entry date is, on that date, an entity that has 50 employees or less or is a university, other than an entity referred to in subparagraph (a)(i) or (ii); and
  3. in respect of a divisional application, the applicable requirements of this subsection are met in respect of the original application.
